PLEA
AGREEMENT
In
compliance with Rule 11 (e)(2) of the Federal Rules of
Criminal Procedure, the United States of America and the
Defendant in this case acknowledge the following plea
agreement between the United States, by and through the
United States Attorney for the District, the defendant,
ANGELA SMITH, and the defendant's counsel:
1. The defendant has agreed to plead guilty to count 1
(one) of the indictment filed against her, charging her
with possession with intent to distribute 640 grams of
cocaine in violation of 21 U.S.C. §§ 841(a)(1)
and 841(b)(1)(B). The defendant realizes that this offense
is punishable by a term of imprisonment which may not
be less than 5 years nor more than 40 years-
2. The defendant and the United States have agreed and
stipulated that the following facts constitute the factual
basis for the defendant's plea of guilty in this case:
The defendant admits that on May 8,2003, she possessed
with intent to distribute 640 grams of cocaine, a controlled
substance- The offense occurred in Bigtown Memorial
Park, located at the intersection of Fifth and Western
Streets in Bigtown.
3. The United States has agreed that if the defendant
enters a plea of guilty to count 1 (one) of the indictment
against her, the United States will dismiss the remaining
counts of the indictment against the defendant at the
time of sentencing and will not subject the defendant
to additional federal criminal prosecution for crimes
committed in this judicial district prior to the date
of this agreement-
4- The United States and the defendant have agreed and
stipulated that the defendant has clearly demonstrated
a recognition and affirmative acceptance of personal responsibility
for her criminal conduct, and has given the government
timely notice of her intention to enter a guilty plea,
allowing it to save resources and avoid preparation for
trial.
5- The United States and the defendant have further agreed
that the United States will recommend to the court at
sentencing that the defendant be given a three-point reduction
of her offense level, under § 3B1 of the Sentencing
Guidelines, for acceptance of responsibility.
